These Terms and Conditions govern your use of the website at amanahy.sbs and describe the basis on which Amanah provides legal services to clients. Please read them carefully. By using our website or engaging our services, you agree to be bound by these terms.

These terms do not replace the specific terms contained in any engagement letter or client care document issued to you when you instruct us in relation to a legal matter. In the event of any inconsistency, the engagement letter shall prevail.

Amanah is a legal practice focused on inheritance law in Malaysia, operating from George Town, Penang. We are qualified and regulated under the Legal Profession Act 1976 (Malaysia) and are members of the Malaysian Bar Council.

2. Use of This Website

Until that point, no legal advice is given, no obligation is owed by either party, and all communications remain exploratory.

4. Our Services

We offer the following legal services, which are described in greater detail on our Solutions page:

  • Trust Drafting and Settlement — preparation of family trust instruments under Malaysian law.
  • Inheritance Dispute Counsel — legal representation and advice in estate disputes.
  • Beneficiary Letter Drafting — preparation of formal correspondence in relation to estate distributions.

The scope, fee, and timeline for any engagement will be set out in a written engagement letter specific to your matter. Fees stated on our website represent indicative starting figures and may vary depending on the complexity of the matter.

5. Fees and Payment

Fees for our legal services are set out in the engagement letter issued at the commencement of each matter. The following general terms apply:

  • Fees are quoted in Malaysian Ringgit (RM) and are inclusive of the firm's professional charges unless otherwise stated.
  • Disbursements — including filing fees, stamp duty, courier charges, and other out-of-pocket expenses — are charged separately and will be set out in invoices as they arise.
  • Invoices are payable within fourteen (14) days of issue unless otherwise agreed in writing.
  • We may require a deposit before commencing work on a matter. This will be credited against the final invoice.
  • If a matter is concluded or terminated before completion, fees will be calculated on a fair basis reflecting the work undertaken.

6. Confidentiality

All information you share with us in the course of seeking or receiving legal advice is treated as strictly confidential. We will not disclose your information to any third party without your consent, except as required by law, by our professional obligations, or as described in our Privacy Policy.

Information shared in connection with legal advice may also be protected by legal professional privilege, which means it is ordinarily shielded from disclosure in legal proceedings. We will not waive privilege without your express written consent.

7. Intellectual Property

All content on this website — including text, design, structure, and graphics — is the intellectual property of Amanah or its licensors. You may view and print content from this site for your own personal, non-commercial use, but you must not reproduce, modify, distribute, or republish any content without our prior written permission.

If we are unable to resolve your complaint to your satisfaction, you may have recourse to the Advocates and Solicitors Disciplinary Board of Malaysia or the Bar Council of Malaysia.

11. Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising out of or in connection with these terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12. Changes to These Terms

We may update these Terms and Conditions from time to time. When we do, we will revise the "last updated" date at the top of this page. Your continued use of our website after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
