Family trust for a property portfolio

The Situation
A retired couple in George Town owned three properties and wanted to ensure the assets passed to their children in defined shares, with a trustee in place to manage the properties during any period before the children were ready to take them over.
The Approach
Amanah prepared a trust deed covering all three properties, advised on the selection of an independent trustee alongside the children, and drafted the management provisions so the trustee's powers were clear and proportionate. Two meetings were held to work through the implications.
The Outcome
The trust was executed and all three properties transferred into it within ten weeks of the initial instruction. The clients noted that having the trustee's duties written out clearly gave them considerable confidence in the arrangement.
Dispute over will validity

The Situation
A client approached us after her late father's will left his property to one sibling only, contradicting a previous will that divided the estate equally. She wished to challenge the later will on the grounds of undue influence.
The Approach
Amanah reviewed the available evidence and gave a candid written assessment of the prospects. We found the case was viable but not strong, and recommended a settlement letter to the executor proposing a compromise distribution before any court application.
The Outcome
The executor, on advice from their own lawyer, agreed to a partial compromise. The client received a portion of the estate that, while less than the original equal share, represented a reasonable outcome given the uncertainty of proceedings. Resolution was reached within four months.
Notice of distribution to three beneficiaries

The Situation
An executor needed to formally notify three beneficiaries of their respective shares in a moderately complex estate involving a shop lot, cash, and personal property. One beneficiary was overseas and one had been previously difficult to communicate with.
The Approach
Amanah prepared separate letters for each beneficiary, calibrated to the relationship and communication history. The letter to the overseas beneficiary included a clear statement of the process for receiving their entitlement from abroad. The letter to the difficult beneficiary was carefully worded to pre-empt the most likely objections.
The Outcome
All three beneficiaries acknowledged receipt. The distribution proceeded without further correspondence being necessary. The executor noted it was the first communication about the estate that had not generated a counter-letter.
